Acceptance of Terms
By accessing or using ShootMuse (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including photographers, studio owners, and any other visitors.
Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your account information.
- Keep your password secure and confidential. You are responsible for all activity under your account.
- Notify us immediately of any unauthorized use of your account.
Subscription Plans & Billing
ShootMuse offers multiple subscription tiers. By selecting a plan, you agree to pay the applicable fees. Key billing terms:
- Subscriptions are billed monthly or annually, depending on the plan you choose.
- Annual plans are billed upfront and include a discount compared to monthly billing.
- All fees are exclusive of taxes, which may be added where required by law.
- We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored at their current rate until renewal.
Free Trial
We may offer a free trial period for new users. During the trial, you will have access to the full features of the selected plan. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. No credit card is required to start a trial.
Cancellation & Refunds
You may cancel your subscription at any time from your account settings.
- 30-day money-back guarantee: If you are not satisfied with the Service, you may request a full refund within 30 days of your initial purchase.
- After the 30-day period, cancellations take effect at the end of your current billing cycle. No partial refunds are provided for unused time.
- Upon cancellation, your data remains accessible for 30 days, after which it will be permanently deleted.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload or transmit viruses, malware, or any other harmful code.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Use the Service to store or distribute content that infringes on intellectual property rights.
- Resell, sublicense, or redistribute the Service without our written consent.
Intellectual Property
The Service, including its design, features, code, and documentation, is owned by ShootMuse and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our prior written consent.
Data Ownership
You own your data. Always.
All content you upload to the Service, including photographs, client information, contracts, invoices, and any other data, remains your sole property. ShootMuse does not claim any ownership rights over your content.
- You can export all of your data at any time in standard formats.
- We will never use your photographs or client data for marketing, training AI models, or any other purpose without your explicit consent.
- We grant you a limited license to use the Service solely for its intended purpose. You grant us a limited license to host and process your data only as necessary to provide the Service.
Limitation of Liability
To the maximum extent permitted by law, ShootMuse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.
Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.
